Every day there are more and more data breach payouts. After the fact, the only thing people who were affected can do is try to protect their data better and look for some kind of compensation. In this case, the new Paycom data breach took place.
Paycom helps thousands of businesses with their payroll and HR technology. In 2023, there was a data breach at Paycom where all of their clients’ personal information saved on their servers was stolen. We know for sure that during the breach, data from clients sent through MOVEit Transfer, a private file transfer app, was accessed, putting the victims’ identities at risk.
A class action lawsuit was made against Paycom after the breach, saying that the company did not take enough cybersecurity measures to stop the breach and should be held responsible for any problems that happened after the fact.
A class action lawsuit is usually brought by one or more people on behalf of a bigger group of people who have similar complaints about a business or organization. If the suit is made a class action, it covers everyone who may have been hurt in the same way.
Companies usually decide to settle these cases by giving money to people in the class. In exchange, these people give up their right to take the case to court again. As part of these agreements, the company usually says it did nothing wrong.
This also happened with the Paycom claim, where the company settled for $900,000 but didn’t say who was at fault and the lawsuit ended. People who were harmed by the breach will soon be able to get some of the settlement money, but they will have to meet a few requirements first.
Paycom settlement eligibility criteria
One of the requirements for getting a payment is that the person must live in the United States. The second and maybe most important requirement is that the person who wants to get some of the settlement must have been touched by the breach. In this case, this means that someone got access to their personal information at Paycom during the breach, which happened from July to October 2023.
When Paycom found out about the breach, they informed everyone whose information had been stolen as soon as possible. If you weren’t notified, you probably don’t have a case. Some people may not have been told directly by the company, but they may have gotten a postcard with a Claim Login ID and Claim Login PIN on it telling them about the payment.
To make sure you are part of the settlement, you should probably call (844) 804-3284 or email info@paycomdatasettlement.com and ask to speak with the class organizer.
Amount to claim in the settlement
People who want to claim a piece of the settlement can do so using the website and information on the letter. The company already knows who was harmed, so they don’t need any more paperwork.
There will be some differences in the amount of money that can be claimed, though. Anyone who can prove they lost money because of the breach can get up to $2,500 per person. Anyone who lost money because their name was stolen after the breach can get up to $4,200 and access to credit monitoring services for three years.
Many people who are impacted should be aware of two deadlines that fall on the same day, November 7, 2024. These dates cover the deadlines for making the claim or the objection and exclusion. People who didn’t do either will miss out on the current payment and the chance to make a claim in the future if their case is different from what is being described in this suit.
