As the boy went down the stairs to throw away his trash, the suspect is said to have sexually attacked him, according to the district attorney’s office.
He is then said to have taken the victim’s phone and run away when he heard the 13-year-old’s family calling for him.
The accused child killer was caught and charged on September 24 after the online texts helped identify him, taking the child to Jacobi Hospital for treatment.
DA Darcel Clark said in a statement, “This defendant is charged with raping a 13-year-old boy who he met online and then went to his building.”
“This child has been hurt, and we will do everything we can to help him get through this.”
Francis is also accused of two counts of third-degree rape, two counts of sexual misconduct, putting a child in danger, and fourth-degree big theft.
Francis was given more time on supervised release during his court date in the Bronx on Monday. His next court date is January 7, 2025.
